Description:

Folio 355: V. Bathurst, Judge Advocate, Portsmouth. Reports on several Courts Martial held aboard the Carlisle at Spithead on the 25th and 26th, under the presidency of Sir Francis Wheeler and comprising 15 named Captains. First, Gabriel Nash, Coxswain of the barge of the Eagle, was charged with willfully killing Charles Bly of the barge crew. The court found Nash not guilty. Second, Batty Powle of the Roebuck fireship was charged with committing buggery with David Taylor, Surgeon's boy. The court found that charge not proved but found both men guilty of uncleanness and other scandalous actions falling under the Second Article of War, and sentenced them to receive fifty lashes alongside each of the flagships anchored at Spithead and of the Roebuck. David Taylor afterwards to be turned ashore. The following day the court resumed to enquire into the grounding of the Falmouth, Captain John Beverley, in Ryde Bay. The court found that the grounding was accidental, but that Beverly and Thomas Garland, Master, had allowed the ship to stand in too near to the shore, and sentenced them to the loss of a month's pay. Next, John Clampe, Boatswain, and William Griffin, Boatswain's Mate of the York were accused of embezzlement of stores. The court found them guilty and sentenced them to be hanged. John Valoone, Marine Soldier of the Berwick, in the regiment of the Hon. Henry Killigrew, was charged with stabbing to death a fellow marine, William Pyke. The court found Valoone guilty and sentenced him to be hanged. Finally, Richard Hubbles of the Winchester was charged with embezzlement of stores. The court found him not guilty. Enclosed in f354.
