Indentures of lease and release between William Wilberforce Bird of Wood Street, Cheapside, London, aged 17 years (son and heir of John Bird, late alderman of London, deceased, which said John Bird was second son of John Bird formerly of Coventry, silkman, late of Kenilworth, esq., deceased, and Rebecca his wife also deceased, formerly Rebecca Martyn, spinster; also devisee in trust named in the will of John Bird late of Kenilworth of hereditaments thereinafter mentioned) of the first part, William Bird of Trinity College, Cambridge (only son of Charles Bird late of Wood Street, aforesaid, esq., deceased, who was the eldest son of John Bird late of Kenilworth) of the second part, Elizabeth Bird of Gloucester Street, co. Middx., (only daughter of the said Charles Bird) of the third part, and Edward Montagu of Grays Inn, co. Middx., esq., a Master of the High Court of Chancery of the fourth part (reciting the marriage settlement of John Bird the elder and Rebecca Martyn, whereby John Bird settled £3,500 to be laid out in the purchase of hereditaments to the use of himself and his wife for their lives, with remainder in tail male to their first and other sons, and reciting that there was issue of the marriage two sons, Charles Bird and John Bird the younger, and four daughters, namely Elizabeth late widow of George Secker, D.D., deceased and then wife of Richard Cope Hopton, esq., Ann wife of William Singleton esq., Frances wife of Thomas Selwyn esq., and Pattee, wife of the Reverend James Parker, then deceased without issue; and reciting the death of Rebecca wife of John Bird in the lifetime of her husband and the death of Charles Bird in the lifetime of his father, leaving issue William Bird and Elizabeth Bird; and reciting that John Bird the elder devised to William Bird certain hereditaments in Kenilworth therein specified and to John Bird the younger the residue of his hereditaments in Kenilworth and Halloughton in trust for William Bird) whereby it was witnessed that William Wilberforce Bird (as trustee and heir at law of John Bird the younger) conveyed certain premises therein described in Kenilworth and Halloughton to Edward Montagu to the use of William Bird and the heirs of his body with remainder in default to Elizabeth Bird and the heirs of her body, with remainders in default to the daughters of John Bird the younger and their issue with remainders over to the right heirs of John Bird the elder.
