This collection was deposited by Mr A Jones, solicitor in August 1967.

 

The arrangement seems to follow that of the four cases and original bundles in which they were deposited as noted in the Accessions Register, by Percy Burnett in undertaking his extracts and as summarily listed by John Gaskin in 1988. Numbering does not follow that adopted by Gaskin. The whereabouts of Bundles O and P are unknown - they were not present when Gaskin listed the collection in 1988. It is possible that some at least of the loose deeds formed these bundles.

 

Some of these papers concern Cornelius Clark who executed his will on 23rd July 1803 in which he appointed his brother Richard Clark, Thomas Pierson and George Pierson executors and trustees. The will instructed the trustees to sell all his real and personal property and to hold the proceeds in trust for his five illegitimate children by Hannah Metcalf, whom he had recently married, and any subsequent children. Hannah Metcalf was to receive the interest on the invested trust funds during her widowhood and the minority of the children.

 

Cornelius Clark died on 13th October 1817, by which time he had had a further daughter, and his eldest son and two eldest daughters were of age. Thomas and George Pierson refused to act as executors and trustees because of the widow's fractiousness, Richard Clark only doing so after being persuaded that it was in the best interest of his brother's children. As Richard Clark lived in Bath, he employed Francis Wardale to act as agent on his behalf in the settlement of the estate.

 

Some papers relate to Hannah Ness. In her will dated 26 Jul 1866 and proved at York on 28 Nov 1868 Hannah Ness left a farm at Leatherholm Lawns in the township of Glazedale to John Ruddock upon trust to let the farm and pay the income to her son John Ness for life, on his death the income was to be paid to her daughter Jane Walker: on the death of the survivor of them, the farm was devised to the children of the said Jane Walker. The testatrix also devised to Jane Walker use for life of the farm known as High Farm and the messuage in Ainthorpe in which the testatrix lived; on the death of Jane Walker these were devised to her children.

 

Some papers relate to Ann Littlefair. In her will dated 23 Aug 1777 Ann Littlefair appointed Wakefield Simpson her trustee and devised him £300.0.0 upon trust to invest and pay the income to her daughter Ann Ware; after Ann Ware's death the principal sum was to be held upon trust for Ann Ware's children.

 

Some papers relate to the trusts established under the marriage settlement of Elizabeth Ann Noble and Francis Burnett and her will. Legal problems arose because these trusts, being charitable in nature were invalid under the Statute of Mortmain, although she died after the Mortmain and Charitable Uses Act, 1891, under which they would have been valid.
