Exemplification,

 

Of a decree of the court of Chancery, dated 7 December, 1661.

 

Lewis Dowrich of Dowrich, esq., plaintiff.

 

Edmond Crockett and Ellen his wife, defendants.

 

Mansion house and lands, known as Dowrich, in Sandford. Recites that by the will of Thomas Dowrich, plaintiff was to obtain the house and lands of Dowrich, conditional upon paying certain legacies to Ellen, relict of Thomas Dowrich, and to Ellen, daughter of Thomas Dowrich and now Ellen Crockett on her reaching the age of 13. The legacies have all been paid, but it has not been possible to ascertain the exact date of birth of Ellen Crockett, and consequently the plaintiff has been unable to establish fully his title, because he cannot prove that he paid Ellen her legacy as soon as she reached the age of 13.

 

The court decrees that as soon as Ellen is of age the defendants shall give the plaintiff a full discharge for all sums due from him.

 

The will of Thomas Dowrich is recited in full.
